Actually, I think 'posession' is the criteria for prosecution so anybody who has visited the website is technically in posession as it causes a copy, temporary or otherwise, to be made. But if you've just been exposed to it by watching telly or if it goes on a poster campaign, you should be in the clear. So the answer is 'starting with Gordon and his staff and going on to everybody who uses the web and got boombed by it, including any television stations and billboard owners, but excluding analogue on-air viewers or innocent passers-by. But I'm not a lawyer, so what do I know? Nothing.
