Yesterday the Telegraph's James Kirkup got all excited and published a story about a gloating email from Guido to the entire Lobby that was cheekily routed by hacking the Tory Press Office mail-server's distribution list. When Guido explained the process to the sceptical and awfully posh Nice-But-Dim-Jim, he didn't understand. So rather than e-x-p-l-a-i-n i-t s-l-o-w-l-y to him yet again, Guido demonstrated by sending a piss-take mock press release in the style of the Tory Press Office using the same process.
He published it verbatim, including the hitherto unrevealed email address that is a gateway to the inboxes of the Lobby's Blackberries. Guido called him immediately to tell him that he had just done something very stupid. Perhaps still not grasping the ramifications he just said enigmatically "the wonders of modern technology".
Predictably, overnight this has resulted in assorted lefties emailing four-letter abuse to the Lobby's finest. Do you think James Kirkup is going to be popular with his colleagues on Monday morning?

Guido used a mail server to send mail. That's what it's designed for - so no offence under the Computer Misuse Act 1990.
He sent mail to a list of "business users" so no offence there.
But the owner of the list has possibly committed an offence under the data protection act for failing to keep data securely.
Then again I'm not a lawyer, just a humble geek.
It amazes me that Guido has never been sued. How does he get away with it?
We moan about the wimpish MSM but, unlike Guido, they and their shareholders are in constant fear of PCR (for the uninitiated that's Peter Carter-Fuck, £100 a minute libel lawyers). How come Guido ain't?
Kirkup would do better covering Brown's attempt to gag debate on the EU treaty by regaging on his promise of more than 20 days debate time.
All this is very complicated.
Why does Guido concentrate on Labour? I'll tell you: because they are a richer hunting ground.
Tory sleaze - a few million here, a few million there - tends to hurt their own with perhaps a bit of collateral fallout. By and large they leave ordinary people alone.
But New Labour are natural control freaks who enjoy worming their way into our minds in a never-ending attempt to change our habits and our thinking.

Mr. Kirkup's confusion reminds me of that excellent Youtube clip of some dozy old Romanian crossing the rally track in a a forest stage, and being lightly brushed by a car in a sideways slide at around 50 mph. He bumbles on to the other side as if nothing has happened, blissfully unaware of having courted death. So it is, clearly, with young James here.
Guido, While you were just spouting bile and venom you could be safely ignored. But now that you have taken on the establishment, you had better know what you are getting yourself into.
You are playing with the big boys now, just like you would be if you were taking on the mafia, a drug cartel or the tobacco industry.

fair comment is also protected under free speech, so if you are making a fair comment that is true, if they try to sue for libel the accusation would be tested by the courts. all their dirty secrets would then be exposed for all to see and not just available here.

Thick as Thieves, you need to understand the distinction between fact and comment. "Peter Hain channelled £100,000 worth of donations through a near-inactive think tank called Progressive Policies Forum)" is a fact. "Ken Livingstone is a cunt" is comment - an opinion. It also uses vulgar abuse, which is not actionable.
The reality is that Carter-Fuck does not bother Guido because he knows he has no resources. They could sue, but would be lucky to get a sucked lemon in damages. But a national daily, insured to the eyeballs, presents the snouts with a very large trough full of delicious swill.

for example, I frequently use fairly salty language but always combine it with factual points, a hybrid of comment and fact.
by doing that my profanities would have to be taken in the factual context of my own design. a get out clause if you like. swear words may not be actionable but anyone who swears just for the sake of it is really just abusing the privilege.

If Kevin Maguire still had an ounce of journalistic integrity about him he would have had a story that still fitted the Daily Mirror's pro-Labour/Anit-Tory agenda.
He could have written about the Tories press office being so unprofessional that they had an unsecured email distribution list open to any users who cared to spam the Lobby pack.
Instead he and others have now blown the story in a fit of egotistical pique.
